It’s that time again: Apple has once again filed a claim. But remarkably, this time it concerns a Dutch authority that holds the company liable, following the example of an American case that has already cost Apple hundreds of millions. But what exactly did Apple do wrong?

It has to do with the iPhone 6 (Plus), 6s (Plus), 7 (Plus) and first generation iPhone SE. These iPhone models suffered from a problem: a peak in the processor could cause more power to be required from the battery than could be supplied, causing the iPhone to fail. To combat this, the processor of these iPhones was slowed down via updates around 2017 and 2018. Not a bad move, if it were not for the fact that Apple did not properly inform its users about this.
High chance of success
Apple is now taking action due to the lack of communication, which caused users to have batteries or even entire iPhones replaced. ConsumerClaim and the Aequitas Advocacy Foundation hold Apple liable and want to recover damages (if necessary) through a collective procedure.
There is a good chance that this ‘iPhone claim’ plan will succeed. A similar case took place in the US, where Apple ultimately settled for more than 600 million dollars, and in France and Italy large fines of millions were imposed due to the delayed iPhones.
