Former radio DJs Wietze de Jager and his wife Lieke Veld are not entitled to more than 120,000 euros. They demanded that money from the potential buyers of their home in Zwolle, who were unable to obtain financing. Wietze and Lieke took the couple to court, but according to the court, the reservation of financing was rightly invoked.

Wietze and Lieke will put their villa in Zwolle up for sale at the end of 2022 for an amount of more than 1.2 million euros. According to RTV Oost, a couple with young children made an offer, which was accepted by the radio DJs shortly afterwards. After a few weeks it turned out that the potential buyers could not raise the necessary 1.2 million euros. They relied on the financing reservation in the purchase contract.

Wietze believes that the potential buyers have not fulfilled the so-called best efforts obligation for the purchase of the house and demanded compensation in court of 10 percent of the purchase price, approximately 120 thousand euros. The court in Zwolle rejects that claim.

No violation

“There has been no evidence of a violation of the obligation to make efforts,” the court writes in the judgment. “The bank processed their mortgage application and ultimately rejected it. The agreement shows that the rejection of one recognized lending banking institution is sufficient.”

Wietze and Lieke can’t just whistle for the money; they must also pay legal costs of more than 6,300 euros. The two radio DJs now live on Bonaire.
