A 71-year-old woman was sentenced to 3.5 years in prison on Tuesday after an argument over damage to the windows in 2022 got so out of hand that a 38-year-old Polish woman was killed. During the argument in Lith, the victim was taken more than a hundred meters onto the hood of the 71-year-old’s car, then launched and run over. “3.5 years is a mild sentence, eight years was demanded. However, I disagree with the judge,” the woman’s lawyer said on Tuesday. He is considering appealing.

The ruling turned on the question of whether it was intentional or not. “Also according to the court, there was no intent, but there was a real chance of falling and dying. According to the court, my client would have consciously taken that chance. That is why she was convicted of attempted manslaughter against the Polish man and manslaughter of the Polish woman,” says her lawyer Mark Nillesen.

According to the court, the Polish woman lay on the hood and the Polish man hung from the door of the car. Only when the woman from Lith caused a collision did she stop.

Grabbed by the neck
“On that basis you cannot conclude that there was intent. There are indications that things turned out differently,” says Nillesen. “The accident happened in nine seconds. At that moment, my client was grabbed by the neck by the man and she continued to drive straight ahead. There was no question of driving. After the accident, my client kept repeating what had happened to witnesses. According to a psychologist, that was not acted, but authentic.”

Nillesen and his client are considering an appeal. “The current sentence is lower. But that would mean that my client would have to spend another year in prison. By the time the appeal is filed, the sentence will probably already have been served. My client is very sad, elderly and has serious medical complaints. A year in jail is very problematic for her.
