Possession of cannabis up to 25 grams on the street and home cultivation of 3 plants allowed in Germany
Today the Cannabis Act (CanG) came into effect, after the Bundestag and the Bundesrat had previously agreed to the legislation.
Below is a brief summary of what is allowed.
Possession and consumption of cannabis
The law allows the possession of cannabis up to 30 grams and the home cultivation of cannabis up to 50 grams (previously 25 grams).
Possession of an amount between 25 and 30 grams is considered an offense. The penalty only applies for quantities above 30 grams. Previously, the limit for criminality was already provided for from 25 grams.
It is prohibited to consume cannabis within sight (100 meters) of childcare centers, schools and other youth institutions.
Home cultivation of cannabis in Germany
As of today, growing cannabis up to 50 grams at home is also allowed. Instead of the originally planned 25 grams, it will be possible to store 50 grams of your three cannabis plants.
Growing more than 50 grams will still be a punishable offense. So the rest must be destroyed.
The plants must also be shielded from children.
Growing associations will come later
From July 1, it will only be possible for cultivation associations to apply for a permit.
A maximum of 500 members who must have their place of residence or residence in Germany will be able to become members of a cultivation association.
You may only be a member of a maximum of one cultivation association.
At the cultivation associations, cannabis may only be distributed to members to a limited extent (maximum 25 grams per day or 50 grams per month), although membership and age must be verified.
The distribution of cannabis to young people between the ages of 18 and 21 is permitted up to a maximum of 30 grams per month with a THC content limit of ten percent.
Only cannabis or hashish products may be distributed.
Furthermore, there is a general ban on advertising and sponsorship for cannabis consumption and cultivation associations.
THC limit value has yet to be determined
The legislation was also supposed to establish a new THC limit value in traffic, but the committee had returned the order because they could not reach an agreement.
The current value of 1.0 nanograms per milliliter of blood serum is considered too low. This value can be exceeded days or even weeks after use.
Pilot projects with cannabis stores will follow later
It will take some time before you can go to Germany and buy cannabis in a special store there. To achieve this, new legislation must first be drawn up and approved by politicians.
