In May 2022, a pregnant mare died and another horse belonging to a couple from Bergeijk was injured, after the animals (according to the couple) were startled by a tractor used to combat the oak processionary caterpillar. The couple demanded a claim for damages of more than 25,000 euros from the municipality and the company that carried out the control. The Judiciary reports that the court has now considered the case and has reached a decision.

The court has decided that the municipality and the company cannot be blamed. According to the court, the couple is not entitled to compensation due to, among other things, the following facts:

  • The municipality has announced the control
  • It is unclear what exactly happened to the horses that night
  • It is unclear what the exact cause of death was for one of the animals
  • The danger of the night-time work was unforeseeable
