The Flemish Regulator for the Media (VRM) has issued a warning to influencers Kim Van Oncen, Véronique Leysen, Lies Clerx, Robert Van Impe and Kirilove CommV for non-compliance with the media decree.

In videos on social media platforms they violated Article 53, which stipulates that commercial communications must be easily recognizable as such. The independent supervisory authority for the Flemish audiovisual media reported this on Wednesday.

The VRM research cell checked online videos on a number of platform services, such as Instagram, Tiktok and YouTube, between May 7, 2023 and June 4, 2023.

Influencers may broadcast commercial communications if they are easily recognizable as such. “According to the Content Creator Protocol (CCP), there must be a clearly recognizable indication if the following three elements are cumulatively present in each video: the word “advertisement” or “publicity” is at the beginning of the description; the brand, product or service is tagged at the beginning of the description and the “disclosure feature” for the use of commercial communications of the platform service was activated when uploading the video,” it said.

The five influencers mentioned committed a violation of the provisions of Article 53, concludes the VRM, which warns them about this violation.
