The assize trial on the terrorist attacks of 22 March 2016 in Brussels and Zaventem, which will start on 10 October, presents the Brussels Court of Appeal with many problems. For example, in the nine months that the trial will last, the court will not have access to five of its lawyers. “That while our court is already struggling with a structural understaffing and the judicial backlog is already sky-high,” says press magistrate Anne Leclercq.

The first president of the Brussels Court of Appeal, Laurence Massart, will lead the assize process himself. In addition, a reserve chair is provided, while the press magistrate, also a councilor, will be responsible for communication throughout the process. Finally, there are two other justices, who were investigating judges at the time of the attacks, and who helped lead the investigation. They will speak as witnesses at the trial and must remain available to the assize court. In addition, two other justices will also have to take care of the day-to-day management of the court, to make up for the absence of chairman Massart.

Four new justices were recently appointed, but even then the Court of Appeal will not be able to fulfill all its duties, according to press magistrate Anne Leclercq: “That reinforcement is insufficient. After all, since the beginning of 2022, the court has been flooded by a number of particularly large files from the federal prosecutor’s office, in addition to the trial about the attacks.”

The court of assize also calls on four judges from the court of first instance and a large number of clerks and employees, which creates additional problems, including for the organization of other assizes in the coming months.
